Ateeq Ur Rehman Enforced Disappearance Case
Justice Miangul Hassan Aurangzeb presided over the hearing on writ petition filed by Hajra Bibi, sister of Ateeq Ur Rehman. Adv. ImaanHazir & Adv. HadiAli were representing Hajra Bibi.
Ateeq Ur Rehman was employee of Pakistan Atomic Cimsision and was taken away armed forces personnel on his wedding day on June 25th, 2004. FIR was registered with a delay. Commission of Inquiry on Enforced Disappearance issued production order of Ateeq on March 21st, 2014
Justice Aurangzeb remarked that, where are the enforced disappearances defined? Adv. Mazari said, regulation 02 COIED Act and section 10 talks about the production orders of the abductee.
Justice Aurangzeb inquired, whats the avenue if LEAs and Intelligence agencies defy the orders of COIED? Adv. Mazari replied, according to clause 8 1 a of 2017 Act, chairman of the commission has powers of a High Court Judge. She further said, out of 667 production orders issued by the commission only 61 have been complied. She also said there are 6 volumes of inquiry in the commission but we don’t know what they are. DG ISI & DG MI have even challenged production orders of Ateeq Ur Rehman but technically they can’t do that.
Justice Aurangzeb told prosecution that, court would want to see the material after which production orders were passed, if they’re classified than you bring them in sealed envelope. He also ordered to bring the review petition which was filed by DG ISI & DG MI.
Justice Aurangzeb while dictating order said, commission hasn’t initiated any proceedings after issuing Production orders. Review petition was filed by DG ISI & MI which is pending before the comssion.
He also remarked menace of citizens going missing has become rampant.
The hearing has been adjourned till next Wednesday.
Adv. Mazari argued before the court that petition also talks about the compliance of production orders as well as disbanding of the commission to which Justice Aurangzeb remarked, “If you’ll convince me, I’ll disband the commission”.
